GENERAL RENTAL CONDITIONS

 

Adrenaline Breeze unipessoal Lda. (AB4Rent), through this document, rents to the customer who signed the vehicle described in the terms and conditions of this document by virtue of which, the customer is aware and agrees.

1) The customer received the vehicle in perfect working condition.

2) The said vehicle will only be driven by the customer and will not be used: a. For transporting of goods in violation of customs regulations or which is in any way illegal; b. For the transportation of goods or passengers in exchange for any remuneration or compensation, implicit or explicit; c. To pull or push any vehicle or trailer and for sporting events; d. By any person under the influence of alcohol or narcotics.

3) The minimum driver age is 21 years old, except for the young driver fee. Valid driving license in Portugal with a minimum of 1 year of experience.

 4)The vehicle is delivered with a company sticker (AB4Rent) stamped on the trunk, triangle and warning vest, normal tools, spare wheel or anti-puncture kit, booklet and property registration title or D.U.A., insurance letter and inspection form; a. In the event of total or partial loss or destruction of the vehicle's documentation by the Customer, the Customer will be obliged to compensate the rental company for the inherent losses, namely for the expenses arising from the issuance of second copies of documentation and administrative expenses by the Rental Company.

5) The contracts do not support: Fuel tax (The Renter must return the vehicle with the same fuel level, if it is lower, a fee of €25 will be charged for each 1/4 tank of Fuel missing), washing fee (In the event of excessive dirt (interior or exterior), a cleaning fee of €15 will be applied, fines and in the event of an accident, towing the vehicle to the rental office of origin: Rates do not include collision compensation expenses. The customer is responsible for maintaining the vehicle and its equipment throughout the rental period, including checking the oil, fuel, water and tire pressure levels.

6) Prices include civil liability insurance. The customer can opt for Premium complementary insurance. In the event of an accident due to speeding, driving under the influence of alcohol or narcotics, or due to negligence, the premium insurance becomes void, with the customer paying Adrenaline Breeze unipessoal Lda the entire repair costs, towing the vehicle to the station origin, as well as compensation corresponding to the downtime of the injured vehicle.

Any damage done to the vehicle is the responsibility of the customer who has chosen the CDW (deposit) option. Customer assistance is also charged if the breakdown is your responsibility and not due to mechanical failure or in cases where the vehicle has a spare wheel and the customer requests assistance. Damage caused by negligence is also not covered by insurance, and must be charged to the customer who opted for CDW OR SCDW according to the following cost values:

- Filling up with the wrong fuel: €750

- Loss of documents: €185

-Travel to assistance for which the customer is responsible: €75

- Damage to the engine or gearbox, for example the clutch, is not covered by CDW or SCDW, the value varies for each vehicle.

7) The rental ends on the day and time set by the renter. If you wish to extend the rental period, the renter must go to the nearest station to update their rental contract up to 24 hours before it ends. In the event that there is no such consent, the vehicle is considered to move without authorization and against the will of its owner, the fact being punished by law, and the responsibility of the driver, with a default rate of 100€ plus the rental day value and insurance

8) If the customer violates the Rental Agreement, Adrenaline Breeze unipessoal Lda may immediately terminate the rental agreement without prior notice and recover the vehicle at any facility or location the CLIENT being responsible and owing indemnify Adrenaline Breeze unipessoal Lda  against all actions, complaints, costs and consequential or recurring damages of this same recovery and withdrawal.

9) If the customer opts for CDW insurance a refundable deposit should also be left in the amount of the insurance deductible, to cover any damages.

10) The customer also agrees to protect the interests of the lessor and the rental insurance company, in the event of an accident during the rental period and as follows: a. Obtaining the names and addresses of the persons involved and witnesses;

b. Not pleading responsible or guilty; c. Not abandoning said vehicle without taking the appropriate measures to protect and safeguard it; d. Notifying the police immediately;

11). In the event of an accident, loss, damage or theft, the incident must be immediately reported to the competent police authorities and Adrenaline Breeze unipessoal Lda. (AB4Rent). The lessee is obliged to complete the friendly accident declaration with as much data as possible, otherwise, the CDW and SCDW insurance options will be considered null and void. The lessee undertakes to cooperate with Adrenaline Breeze unipessoal Lda. (AB4Rent) and its insurers in any subsequent investigation or legal proceeding.

12) Any editions or changes to the terms and conditions of this document will be void unless they have been agreed in writing.

13) The rental contract is made with the laws of the country in which it is signed and governed by them. Both parties now agree that the resolution of any dispute arising from this contract, the Judicial Court of the District of Funchal will be competent, unless it involves serious inconveniences for one of the parties, without the interests of the other justifying it.

14) Adrenaline Breeze unipessoal Lda. (AB4Rent), is not responsible for accidents that are not reported to the police.

15) The lessee consents to the storage by Adrenaline Breeze unipessoal Lda. (AB4Rent) of his personal data contained in this rental agreement. In the event of a breach of this contract by the lessee, your personal data may be revealed or communicated to third parties to the extent necessary to recover the losses inherent in the breach.

16) Adrenaline Breeze unipessoal Lda. (AB4Rent) is not responsible to the lessee or any passenger for the loss or damage caused to personal property carried or left in the vehicle, either during the rental period ,or after the same.

17) Premature delivery of the vehicle will not incur a refund of the amount paid for the rental, refunds relating to cancellation of reservations will be made in accordance with the following rules: up to 15 days before the reservation, we will refund 80% of the amount (minus fees); between 15 and 3 days before booking, we will refund 50% of the amount (minus fees); 3 or less days we will not refund the amount paid. If the customer wishes, they can choose to have a Voucher valid for 2 years without losing any type of value for the first and second rule described above.

18) Payments: We accept payments by debit or credit card, in cash, Paypal or bank transfer. Deposits are accepted in cash and by credit card except American Express.

19) Trailers are supported by the company, except in situations such as: key lost, battery failure due to forgetting lights or radio on while parking, lack of fuel, jam off tar roads and other similar situations. In this cases client must pay 100€ for trailer´s support, even if the client has payed premium insurance.

20) This contract governs the contractual conditions relating to the reservation made, only for cases that have occurred, where Adrenaline Breeze unipessoal Lda (AB4Rent) provided the lessee, on paper or other durable medium, in a timely manner and prior to its execution, containing the mandatory information for it.

21) For the rental of 125cc motorbikes, the CDW has a deductible of €150. For the rental of a four-wheeler the deductible is €380. Motorbike rental is only permitted to those who are at least 20 years old, otherwise a young driver fee may be charged, whether or not it is approved by the lessor and you must also have a license for the category.

22) Helmets are provided by Adrenaline Breeze in a protective bag at no additional cost. Any damage to helmets is the customer's responsibility, with a fee of up to €60 being implemented.

23) It is possible to extend the rental period. The company must be contacted 24 hours before the end of the rental period in order to check the availability of the period extension and the customer must stop by the store to extend this contract so that the contract is updated and legal.

24) When returning the motorcycle, the fuel level must be the same as when it was collected, otherwise a fee of €15 will be applied for each 1/4 of fuel missing.

25) CDW does not cover acts of vandalism and natural disasters.

26) The customer with CDW is responsible for any damage.

27) The customer is responsible for fines of any kind, loss or damage to the key, use of the wrong fuel, transgressions and acts of negligence towards the vehicle or third parties, poor driving or incorrect handling of the motorcycle.

28) The client is responsible for situations arising from driving under the influence of alcohol, drugs, or other narcotic substances, as well as the damages resulting from this situation.

29) All types of motorcycles use 95 or 98 gasoline as fuel.

30) The customer is responsible for the conservation of the motorcycle and the respective equipment supplied by the rental company, during the entire rental period, and should check, namely, the oil and fuel levels, water and tire pressure.

31) Premature delivery of the motorcycle will not result in a refund of the rental price paid.

INSURANCE: TERMS OF USE AND CONDITIONS

Full coverage insurance (SCDW)

When subscribed, the full coverage insurance covers all damages in all car bodywork,except:

 

• Roof;

• Interiors (feet scratches on the dashboard, cigarette burns on the seats);

• Key loss;

• Supplying car with wrong fuel;

Parking and overspeeding tickets;

• Driving under alcohol effect (or other psychotropic substances).

In case of accident, tyre puncture or any other damage, please:

• Inform the car rental company immediately (inclusively, take picture of the damage and send to services).

• Do not sign any document without the presence of an authority (police emergency call 112).

• In case of a tyre puncture, if the car is provided with an extra tyre, driver will change it by himself. If there is not an extra tyre, please call the company.

.Clutch

Normal insurance (regular third party coverage insurance- implies a safety deposit)

In case of accident or any other damage, the repair value will be deducted from the value of the deposit. If the client has his/her own insurance, procedure will be the same. Every needed documents will be printed and provided to the client so he can deal with his/her insurance company.

On the other hand, the user consents to the information about the service contracted with Ab4Rent in order to offer additional services to the contractor.
